Watch Where You’re Going! Laws Sought for Distracted Pedestrians

Lawmakers aren’t just worried about distracted driving anymore. Distracted walking, jogging and bicycling also are on the legislative radar screen.

New York, California and Oregon have proposed legislation to address the hazards posed by pedestrians fumbling with their iPods or cell phones while walking across a busy intersection, The New York Times reports.

In a report released last week, the Governors Highway Safety Association, which represents state highway safety agencies, said pedestrian fatalities increased slightly, to 1,891, in the first six months of 2010. “While the increase is small – 0.4 percent – it is notable because overall traffic fatalities during this period were significantly down, and this comes on the heels of four straight years of steady declines in pedestrian deaths,” the association said in a news release.

The proposed New York bill would ban the use of mobile phones, iPods or other electronic devices while crossing streets — runners and others  included. Legislation pending in Oregon would restrict bicyclists from using mobile phones and music players, and in California a lawmaker has reintroduced a bill that would fine bicyclists $20 for similar multitasking.

“The big thing has been distracted driving, but now it’s moving into other ways technology can distract you, into everyday things,” said Anne Teigen, a policy specialist for the National Conference of State Legislatures.

Supporters of such legislation are concerned about “auditory masking” that prevents earbud-using runners and others from hearing, say, a beep from a car.

But to some, the proposals smack of the “nanny state.” “I think it’s an infringement on personal rights,” one jogger exercising in New York’s Central Park told The Times. “At some point, we need to take responsibility for our own stupidity.”

Earlier this week, an Arkansas legislator withdrew a much-criticized proposal that would have banned pedestrians from wearing headphones in both ears.
