An environmental lab that specialized in certifying the results of asbestos removal work and three of its employees have been convicted of fraud, lying to federal investigators and violating the Clean Air Act.
A federal jury convicted Certified Environmental Services of Syracuse, N.Y., along with two of its managers and a lower-level staffer, of conspiring with an asbestos abatement company to falsify reports and provide bogus verification that the chemical was being properly removed from homes, offices and schools.
As a result of the fraudulent reports, which were produced by Certified from 1999 to 2007, people may have been exposed for years to asbestos that was supposed to be gone, putting them at a greater risk of developing illnesses such as lung cancer.
Certified’s role was to submit reports to the EPA to verify compliance with federal environmental regulations, which, in theory, should reduce the agency’s burden.
According to the Justice Department, Certified faces a fine of up to $7.5 million, plus restitution. The convicted employees all face maximum sentences of 40 years or more, along with maximum fines ranging from $1 million to $3 million. Sentencing is set for Feb. 25.
