Oregon Pulls the Plug on Electronic Cigarette Maker

A leading electronic cigarette manufacturer has agreed to snuff out its sales in Oregon.

The state’s attorney general, John Kroger, said he took action against Smoking Everywhere Inc. to halt its sales because the company did not seek U.S. Food and Drug Administration approval before marketing its so-called e-cigarettes as a safer alternative to tobacco. In a statement, Kroger added that the company provided no evidence to back up its marketing claims.

Last year, Oregon became the first state to go to court to restrict the sale of e-cigarettes. In 2009, Kroger persuaded two travel store chains to stop selling e-cigarettes, and forced another e-cigarette company, Sottera Inc., to shut down in the state, The Associated Press reports.

Smoking Everywhere’s e-cigarettes consist of a battery-powered heating device and a replaceable plastic cartridge containing chemicals, including liquid nicotine. The heat turns the liquid into a vapor similar in flavor to tobacco, without actually producing smoke.

The FDA has warned consumers that e-cigarettes may contain carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze. It banned imports of the product last year, but the move was reversed in January by a judge who found that the agency overstepped its authority. The case goes to a federal appeals court next month.

Under the agreement with Oregon, Smoking Everywhere admits to violating the state’s Unlawful Trade Practices Act. It will pay more than $95,000 to the state Department of Justice. The company also is permanently barred from doing business in the state. Its president, Elico Taieb,will pay $25,000 and  is banned from conducting any business related to tobacco, nicotine or drugs.

Taieb could not be reached for comment.

    Is this like banning marlboro while winston, camel, loose tobacco and all others are still present? Also, everyone i know buys their e-cigarettes online. It’s cheaper and the quality can be better.

    I have been smoking for over 21 years , and three months ago switched to e-cigs and since have regainied my lung capacity, can run a mile in 5:30 (which I haven’t done since high school) . I dont wake up any more coughing for the fist 20 minutes of my day , and I have not felt healthier in quite sometime. I also only use reputable liquids that are prop. glycol, or veg. glycerin and made in america. I think this is some Lobbist move to take and rid this state of e-cigs and force users to go back to tobacco which they tax the &%#$ out of. Honesty I like the choice of either buying them or leaving them alone .Since when did America beome the 4th Reich. Seriously

    I have not smoked a regular cigarette since Jun thanks to my ecig. I smoked for over 35 years. I have not coughed after the first week since I quit. My health is better now than 20 years ago, I now have more energy and I am thankful I discovered ecig. If OR wants to play their game, just go online line to purchase them. For those of you who have tried other stop smoking techniques as I have in the past, I highly recommend the ecig as an alternative. Good luck and better health await you.
