Gun Range Cleaner Takes a Bullet From OSHA

A company that cleans gun ranges faces more than $2 million in penalties for allegedly failing to protect its cleanup workers from serious overexposure to lead.

Miami-based E.N. Range Inc. violated federal lead standards when it neglected to provide protective clothing, showers or blood testing for employees who were exposed to lead during cleaning operations, according to the U.S. Occupational Safety and Health Administration.

The company did not provide adequate respirators, or perform air sampling to determine the extent of workers’ lead exposure, the agency charged. Lead poisoning can lead to brain damage, paralysis, kidney disease or even death.

OSHA charged E.N. with 42 willful or serious violations of the lead standard. It cited the company for improper use of chelating agents, which remove metals from the blood. Under federal standards, the medicines must be approved by the Food and Drug Administration and be used under clinical supervision, since they can have serious adverse effects. E.N., however, administered non-FDA-approved chelating agents in the absence of a doctor, OSHA said.

The company has 15 days to appeal the citations and penalties.

“This company was well aware of what it needed to do to protect its workers from a well-known hazard,” said Secretary of Labor Hilda L. Solis in a statement. “It not only failed to provide that protection, it misled employees – most of whom had limited knowledge of English – into believing that it was providing them with appropriate medical treatment.”

The company’s website boasts that E.N. has “over 30 years of combined experience” in “lead abatement” and “regulatory compliance.” Its services include air sampling and training in use of respirators, the website says.

E.N. Range CEO Tom Taylor said the company plans to contest the citations, but otherwise had no comment.

OSHA has also cited Guns and Knives Inc., a gun range in Lauderdale Lakes, Fla., for lead violations and is seeking $62,000 in penalties.
