A week after hitting Toyota with a $16.4 million penalty for late reporting of a defect that led to sudden acceleration, the National Highway Traffic Safety Administration is considering dealing the car maker a second fine.
The proposed penalty is for a problem with acceleration pedals not addressed in Toyota’s initial recall. If NHTSA issues the penalty and Toyota appeals, the agency would ask the Department of Justice to sue the car maker, the Los Angeles Times reports.
The Associated Press reports Toyota has a history of evasive practices when faced with lawsuits. Dozens of lawsuits and numerous cases show Toyota hid documents, made claims about vehicle components that turned out to be false and lied about previous crashes. Toyota is facing nearly 100 wrongful death lawsuits over recent reports of sudden acceleration. Those cases will be consolidated and tried in federal court in Orange County, Calif.
State Farm Insurance has requested Toyota pick up the tab for crashes linked to unintended acceleration in their vehicles. According to USA Today, other insurers are likely to follow suit and could lead to as much as $30 million in claims against Toyota.
