An Arizona court ruled that the state can convict corporations of criminal offenses for workplace deaths. Judges in the state Court of Appeal said because the legislature defined persons to include corporations, companies could be subject to criminal charges.
Charges were brought against Far West Water & Sewer, Inc., in 2001 after an employee and a subcontractor’s employee were killed by hydrogen sulfide gas in an underground storage tank in Yuma County, Ariz.
The company was convicted of negligent homicide and aggravated assault, and fined $1.77 million. This was the first time an Arizona court has weighed criminal prosecutions of corporations, the Arizona Daily Sun reports.
