Massachusetts Joins Federal Suit Against Johnson & Johnson

Massachusetts signed on to a federal lawsuit against Johnson & Johnson for allegedly paying kickbacks to get its drugs prescribed in nursing homes, The Boston Globe reports. The lawsuit, filed in January, alleges the company paid millions to have the drugs aggressively pushed by the nation’s biggest supplier of drugs to nursing homes. The supplier, Omnicare, then sought reimbursement from Medicaid for the drugs.

Antipsychotic drugs, like Johnson & Johnson’s Risperdal, are approved in treatment of severe mental illnesses, but they’re commonly prescribed for patients with dementia. While doctors are allowed to prescribe drugs for off-label uses, pharmaceuticals are prohibited from promoting or marketing drugs for uses other than those approved by the Food and Drug Administration.
