Jury Awards $17.5 Million Against RJR to Smoker’s Widow

Tobacco company R.J. Reynolds was ordered to pay $17.5 million in damages to a Gainesville, Fla., woman whose husband died of lung cancer in 1995 after 38 years of smoking, The Gainesville Sun reports.

A lawyer for RJR argued the deceased was responsible for choosing to smoke for 38 years and that cigarettes weren’t proven to be the cause of his death. His lung cancer might be a result of the 30 years he worked as a carpenter, the lawyer said.

A jury did not agree. It awarded $5 million in damages and $12.5 million in punitive damages to the widow, according to the Sun.

This was the first case against R.J. Reynolds to be heard in the Gainesville area after a state Supreme Court judge dismissed a class action suit but opened the door to individual lawsuits against the company.
