Judge Says Settlement for 9/11 Workers is Too Low

A federal judge rejected a lawsuit settlement over alleged health injuries reached a week ago between ground zero workers and New York City officials, saying the damages to be paid weren’t enough.

From The New York Times:

[Judge Alvin K. Hellerstein] said he was concerned that the legal fees going to the plaintiffs’ lawyers — about one-third of the settlement — would take ‘a very large bite’ and that he planned to review them. ‘I will fix the reasonableness of the fees,’ he said.

The judge said those fees should be paid by the same city insurance fund that is to cover any settlement and has been covering legal fees incurred by the city.

Last week’s agreement would have required the city to pay out between $575 million and $657.5 million in cases filed by some 10,000 ground zero rescue and cleanup workers, who say they suffered health problems resulting from their work at the World Trade Center site.
